1st District vacates lesser gun charge in 2013 shooting

A man who was convicted of two felony gun charges after a 2013 shooting will have one of the convictions removed from his record after an appeals panel determined both charges were punishment for the same offense.While the 1st District Appellate Court upheld Terrion Butler’s conviction for shooting Donald Moore five times, the panel in an unpublished opinion Friday vacated the lesser gun charge he was convicted of under the one-act, one-crime doctrine.That principle prohibits multiple convictions based on &ldquo …
