The 4th U.S. Circuit Court of Appeals recently affirmed the trial court’s grant of summary judgment in favor of all defendants in an asbestos liability case.Based on the rule in Henderson v. Allied Signal Inc., 644 S.E.2d 724, 727 (S.C. 2007), the court concluded that the plaintiff did not show evidence of exposure to a specific product on a regular basis over some extended period in proximity to where the plaintiff actually worked (the “frequency, regularity and proximity” test).
