A railroad engineer can proceed with a negligence suit against his employer after he was assaulted and injured by a trespasser in an unlit rail cab, the 5th District Appellate Court ruled.The panel’s opinion, issued Friday, reverses a Marion County Circuit Court summary judgment ruling that held plaintiff Shawn Morris, did not prove the assault by an unknown person in the dark train was reasonably foreseeable by the Union Pacific Railroad.Morris filed his lawsuit under the Federal Employers Liability Act (FELA …
