Prosecution errors lead to reversal of battery conviction

A divided state appeals panel has reversed a Calumet City man’s battery conviction that resulted from an incident in which police allegedly used a Taser on him and then arrested him after he called 911 for an ambulance.In a 36-page decision filed June 27, Justice Michael B. Hyman detailed why the panel chose to reverse the man’s conviction — which the state may not retry — because the evidence was legally insufficient to support his conviction.
