Subscriber Agreement for The Chicago Daily Law Bulletin Online

PLEASE SCROLL DOWN AND READ THE SUBSCRIBER AGREEMENT BELOW. This Subscriber Agreement governs your use to The Chicago Daily Law Bulletin Online ("ChicagoLawBulletin.com"), which are electronic news and information services from the Law Bulletin Publishing Company. Your use of ChicagoLawBulletin.com is subject to this Subscriber Agreement and constitutes your consent to all such terms, conditions, policies, and notices embodied in this Subscriber Agreement. If you do not agree to be bound by this Subscriber Agreement, cease use of ChicagoLawBulletin.com.
1. Changes to Subscriber Agreement. We may change the terms of this Agreement at any time by notifying you of the change either electronically or in writing. The changes also will appear in this document. Your use of ChicagoLawBulletin.com after changes are made to this Agreement means that you agree to be bound by such changes.
2. Privacy. Registration data and other information about you is subject to our Privacy Policy. If you are located outside of the United States, note that information that you provide to us is being sent to the United States. By subscribing to ChicagoLawBulletin.com, you consent to your data being sent to the United States.
3. Fees and Payments. As a Subscriber you agree to pay the Subscription Fees and any other charges incurred in connection with your user name and password for ChicagoLawBulletin.com (including any applicable taxes) at the rates in effect when the charges were incurred. We will bill all charges automatically to your credit card. Subscription Fees will be billed at the beginning of your subscription or any renewal. All fees and charges are nonrefundable. We may change the fees and charges then in effect, or add new fees or charges, by giving you notice in advance. If you want to use a different credit card or there is a change in credit card validity or expiration date, or if you believe someone has accessed ChicagoLawBulletin.com using your user name and password without your authorization, you must call Law Bulletin Customer Service at the telephone numbers posted on the Contact Us page. You are responsible for any fees or charges incurred to access ChicagoLawBulletin.com through an Internet service provider or other third party service. You can always find the current Subscription Fees for ChicagoLawBulletin.com by selecting Subscribe.
If you are authorized to access ChicagoLawBulletin.com through arrangements between your employer and us, some or all of these "Fees and Payments" terms may not apply to you. Please contact your employer for details.
4. Renewal. Your subscription will renew automatically, unless we terminate it or you notify us by telephone or mail of your decision to terminate your subscription. You must cancel your subscription before it renews in order to avoid billing of Subscription Fees for the renewal term to your credit card.
5. Limitations on Use. Associated Press text, photo, graphic audio and/or video material shall not be published, broadcast, rewritten for broadcast or publication or redistributed directly or indirectly in any medium. Neither these AP materials nor any portion thereof may be stored in a computer except for personal and non-commercial use. AP will not be held liable for any delays, inaccuracies, errors or omissions therefrom or in the transmission or delivery of all or any part thereof or for any damages arising from any of the foregoing.
a. Only one individual may access ChicagoLawBulletin.com at the same time using the same user name or password, unless we agree otherwise.
b. The content available through ChicagoLawBulletin.com is our property or the property of our licensors and is protected by copyright and other intellectual property laws. You may display or print the content available through ChicagoLawBulletin.com for your personal, non-commercial use only.
You agree not to sell, publish, distribute, retransmit or otherwise provide access to the content received through ChicagoLawBulletin.com to anyone, including your fellow employees, with the following two exceptions:
i) Non-electronic copying of any article or a portion of an article from ChicagoLawBulletin.com is prohibited without permission from Law Bulletin. Copied articles must include all copyright and other proprietary rights notices in the same form in which the notices appear in ChicagoLawBulletin.com, original source attribution, and the phrase &quo;Used with permission from The Chicago Daily Law Bulletin Online.&quo; Please consult the Law Bulletin at 312.644.7800 or visit our Contact Us page for reprints if you need to distribute an article from ChicagoLawBulletin.com to a larger number of individuals, on a regular basis or in any other manner not expressly permitted by this Agreement.
(ii) You may occasionally use our "Email to a Friend" service to e-mail an article from ChicagoLawBulletin.com to a few individuals, without charge. You are not permitted to use this service for the purpose of regularly providing other users with access to content from ChicagoLawBulletin.com.
c. You agree not to create abstracts from, scrape or display headlines from our content fro use on another web site or service. You agree not to post any content from ChicagoLawBulletin.com to newsgroups, mail lists or electronic bulletin boards, without our written consent.

d. You agree not to use ChicagoLawBulletin.com for any unlawful purpose. We reserve the right to terminate or restrict your access to ChicagoLawBulletin.com if, in our opinion, your use of ChicagoLawBulletin.com may violate any laws, infringe upon another person's rights or violate the terms of this Agreement. Also, we may refuse to grant you a user name that impersonates someone else, is protected by trademark or other proprietary right law, or is vulgar or otherwise offensive.
6. Third Party Web Sites. We may link to, or promote, web sites or services from other companies on ChicagoLawBulletin.com or offer you the ability to download software from other companies. You agree that we are not responsible for, and do not control, those web sites, services and software.
7. DISCLAIMERS OF WARRANTIES AND LIMITATIONS ON LIABILITY. YOU AGREE THAT YOUR ACCESS TO AND USE OF CHICAGOLAWBULLETIN.COM AND THE CONTENT AVAILABLE THROUGH CHICAGOLAWBULLETIN.COM IS ON AN "AS-IS," "AS AVAILABLE" BASIS AND WE SPECIFICALLY DISCLAIM ANY REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY REPRESENTATIONS OR WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT GIVE LEGAL ADVICE, AND YOU SHOULD ALWAYS SEEK THE ASSISTANCE OF A PROFESSIONAL FOR LEGAL ADVICE.
THE LAW BULLETIN PUBLISHING COMPANY AND ITS SUBSIDIARIES, AFFILIATES, SHAREHOLDERS, DIRECTORS, OFFICERS, EMPLOYEES AND LICENSORS ("THE LAW BULLETIN PARTIES") WILL NOT BE LIABLE (JOINTLY OR SEVERALLY) TO YOU OR ANY OTHER PERSON AS A RESULT OF YOUR ACCESS OR USE OF CHICAGOLAWBULLETIN.COM FOR INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING, WITHOUT LIMITATIONS, LOST PROFITS, LOST SAVINGS AND LOST REVENUES (COLLECTIVELY, THE "EXCLUDED DAMAGES"), WHETHER OR NOT CHARACTERIZED IN NEGLIGENCE, TORT CONTRACT, OR OTHER THEORY OF LIABILITY, EVEN IF ANY OF THE LAW BULLETIN PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF OR COULD HAVE FORESEEN ANY OF THE EXCLUDED DAMAGES, AND IRRESPECTIVE OF ANY FAILURE OF AN ESSENTIAL PURPOSE OF A LIMITED REMEDY. 8. General. This Agreement contains the final and entire agreement between us regarding your use of ChicagoLawBulletin.com and supersedes all previous and contemporaneous verbal or written negotiations, understandings, or agreement regarding your use of ChicagoLawBulletin.com. We may discontinue or change ChicagoLawBulletin.com, or its availability to you, at any time. This Agreement is personal to you, which means that you may not assign your rights or obligations under this Agreement to anyone. No third party is a beneficiary of this Agreement. You agree that this Agreement, as well as any and all claims arising from this Agreement will be governed by and construed in accordance with the laws of the State of Illinois, United States of America applicable to contracts made entirely within Illinois and wholly performed in Illinois, without regard to any conflict or choice of law principles. The sole jurisdiction and venue for any litigation arising out of this Agreement will be an appropriate federal or state court located in Illinois. This Agreement will not be governed by the United Nations Convention on Contracts for the International Sale of Goods.
9. Additional Terms and Notices. Associated Press text, photos, graphics, audio and/or video material shall not be published, broadcast, rewritten for broadcast or publication or redistributed directly or indirectly in any medium. Neither Associated Press materials nor any portion thereof may be stored in a computer except for personal and non-commercial use. The Associated Press will not be held liable for any delays, inaccuracies, errors or omissions therefrom or in the transmission or delivery of all or any part thereof or any damages arising from any of the foregoing.

Privacy Policy
Law Bulletin Publishing Company (”LBPC”) adopted this privacy policy in recognition of the importance of protecting the privacy of your personally identifiable information. Your privacy is important to LBPC. LBPC’s intent is to balance its legitimate business interest in collecting and using personally identifiable information and your reasonable expectations of privacy. This Privacy Policy applies only to information collected by or through LBPC’s websites and does not apply to information collected or used by LBPC through other means.
1. SUBMISSION OF PERSONALLY IDENTIFIABLE INFORMATION
LBPC asks you to provide personally identifiable information, which is any information that can be used to identify a specific individual, in order to enhance your experience on LBPC’s websites and improve LBPC’s ability to serve you. In order to become a registered user, you must submit information including your name and e-email address. In addition, LBPC asks you to submit information including your year of birth, gender, preferences, and information regarding your job and areas of interest in order to better serve you. LBPC may at times also ask for other information, including, for example, when you submit comments or respond to surveys being conducted on its websites. LBPC also may collect information when you purchase products or services from LBPC offline, but that information is not covered by this Privacy Policy.
2. USE OF PERSONALLY IDENTIFIABLE INFORMATION
LBPC’s intent in collecting personally identifiable information is to provide users with an improved experience on its websites. This may include interactive communications, such as contacting you for a survey. In addition, LBPC may use this information to: (1) contact you with legal notices, (2) advise you of any material changes or additional to LBPC’s User Agreement or this Privacy Policy, and (3) advise you of any changes in your status as a registered user.
LBPC may conduct research based on its users’ demographics, interests, and behavior based on the information provided to LBPC during user registration, as well as on order forms, during promotions, through surveys, and from its server log files. This information is used to better serve its users. Aggregated information, which is statistical information that may be compiled from personally identifiable information but which is not personally identifiable itself, may be shared with advertisers or other businesses. Under a confidentiality agreement, LBPC also may share information with third parties in service of LBPC.
Unless LBPC provides specific notice prior to collecting particular information (such as, for example, prior to a survey), LBPC will not provide users’ personally identifiable information to any third party, except that it may provide or publish information in the aggregate.
LBPC also reserves the right to send you offers about its services and those of its affiliates. If you do not wish to receive these offers, please contact webmaster@lbpc.com to request removal from this list.
If you wish to unregister from LBPC’s sites, please contact webmaster@lbpc.com and ask to have your registration deleted. Once your account has been deleted, you will no longer be able to submit comments and/or other material to LBPC’s websites. You may re-register at any time, unless your account has been terminated by LBPC.
3. APPLICABILITY OF LBPC’S PRIVACY POLICY
LBPC’s advertisers or other websites that have links on LBPC’s websites may also collect personally identifiable information directly from you. This Privacy Policy does not cover the actions of those advertisers or linked websites. Please visit those advertisers or websites to view their privacy policies.
4. PRIVACY WITH RESPECT TO VOLUNTARILY DISCLOSURES
If you voluntarily disclose personal information in comments and/or other materials submitted to LBPC for use on its websites, such information may be collected by other viewers and may result in unsolicited messages from others.
5. DISCLOSURE IN SPECIAL CASES
As stated previously, LBPC will not—without specific notification—as a rule disclose personal information submitted to LBPC to third parties. However, LBPC may disclose such information when required by law, subpoena or order issued by a court or governmental body, or when LBPC has reason to believe that disclosing the information is necessary to identify, contact, or bring legal action against someone who may be violating LBPC’s User Agreement or may be causing injury to or interference with (either intentionally or unintentionally) LBPC’s rights or property, other LBPC users, or anyone else who may be harmed.
6. DATA SECURITY
LBPC has physical, electronic, and managerial procedures to protect the information collected online. However, no security system is impenetrable. LBPC cannot guarantee the security of its database, nor can it guarantee that information will not be intercepted after being transmitted from you to LBPC over the internet.
7. COLLECTION OF INFORMATION BY LBPC SERVERS
LBPC’s web servers automatically collect certain personally identifiable information, such as which pages each user visits and the domain names of visitors. This information is used for a number of purposes internally and may also be provided to advertisers on an aggregated, anonymous basis.
LBPC also places a “cookie” on the browsers of computers of users of its websites to store and track information. A “cookie” is a data file that can be used to tell when your computer has visited a certain website. The information may be used for editorial purposes, for measuring traffic patterns, and to make sure that you do not have to reenter your password multiple times during a visit. Advertisers on LBPC’s website also may have their own cookies.
Any user may opt-out of cookies (including but not limited to LBPC’s cookies) by changing a setting on your browser. Opting out of cookies by changing this setting will disable all cookies and may cause problems with some websites.
8. INDIVIDUALS UNDER THE AGE OF 18
Children under the age of 13 should not send any information to LBPC, including but not limited to names, addresses, or email addresses. LBPC does not knowingly collect information from children under 13. If LBPC learns that it has collected any personal information from a child under the age of 13, it will delete that information from its database as soon as possible.
Teen-agers who are at least 13 years of age may submit personal information only with the permission of, and under the supervision of, a parent or legal guardian. If you are a parent or legal guardian agreeing to LBPC’s User Agreement for the benefit of a teen-ager between the ages of 13 and 18, you are fully responsible for any comments and/or other submissions by the teen-ager and any legal liability that the teen-ager may incur.
9. RIGHT TO ALTER POLICY
Because Internet technology is changing constantly, LBPC reserves the right to change its Privacy Policy, as well as its User Agreement, at any time. If LBPC make revisions to the way it collects or uses personal data, LBPC may provide notice of those changes by taking action as the LBPC deems appropriate under the circumstances, including without limitation, posting the revised draft of this Privacy Policy on its website. Any changes will apply as soon as notice is posted. Your continued use of LBPC’s websites indicates your acceptance of those changes.
