A divided 1st District Appellate Court has found part of the state’s DUI law unconstitutional, relying on a 2013 U.S. Supreme Court precedent.The majority of the appeals panel also reversed the first-degree murder conviction of Ralph Eubanks, who is accused of killing a woman in a 2009 hit-and-run.The split panel, in an opinion issued Dec. 26, reversed Eubanks conviction for aggravated driving under the influence that was based on results of his blood and urine tests, which the court ruled an unconstitutional search. …
