Today’s case involves a trip and fall in a Kmart parking lot during construction where the handicapped-accessible parking spaces were blocked off and the plaintiff sued under state common-law premises negligence theories, alleging, in part, violation of the public accommodations provisions of the Americans with Disabilities Act (ADA).
