Two disgruntled customers seeking “a second bite at the chocolate” do not have a case against a candy maker that purportedly under-fills boxes, a federal judge held.In a written opinion this week, U.S. District Judge Sara L. Ellis again threw out a lawsuit filed against Fannie May Confections Brands Inc. under the Class Action Fairness Act.Ellis held plaintiffs Clarisha Benson and Lorenzo Smith had not stated a claim in their amended suit that Fannie May violated the Illinois Consumer Fraud and Deceptive …
