A Cook County judge dismissed Lisa Dudley’s $1.2 million quantum meruit claim against Alice Lewy’s estate based on the Elder Abuse and Neglect Act — after Dudley pleaded guilty to misdemeanor battery on the then 88-year-old Lewy — but on appeal Dudley insisted the abuse law didn’t apply for two reasons.Section 2-6.2(b) of the statute says someone convicted of abuse, financial exploitation or neglect of an elderly or disabled person “shall not receive any property, benefit or other …

Judge rejects ‘specific patient rule’ in case over false claims, kickbacks
