High court: Jurors, not judge, caused mistrial

SPRINGFIELD — A hung jury and not judicial indiscretion caused the mistrial in a McHenry County sex abuse case, a divided Illinois Supreme Court found Thursday.This means David D. Kimble, accused of sexual abuse of a child, can be retried without risk of double jeopardy, the high court found.This reverses a 2nd District Appellate Court decision that found McHenry County Circuit Judge Sharon L.
