Fetal brain injury nets $12M deal

The mother of a girl who developed cerebral palsy after she sustained brain injuries before she was born has settled her lawsuit against the hospital for $12 million.The parties reached the agreement Aug. 16 before jury selection was set to begin on Aug. 19.On Dec. 25, 2011, plaintiff Esmeralda Vergara went to MacNeal Hospital in Berwyn after she believed her amniotic sac broke earlier that morning.Vergara, who was 29 weeks pregnant, was examined by the labor and delivery triage nurse and the on-call obstetrician.
