In what appears to be Pyrrhic victory for a defendant on death row in Alabama, the Supreme Court late in the evening of Feb. 12 ruled that the death of William B. Smith III by legal injection cannot take place absent him having his pastor present. At the same time, the court lifted a stay on his execution the 11th Circuit had imposed.
