A man who was injured as a passenger in a semitrailer truck that collided with a tow truck on an Illinois interstate settled his lawsuit for $5.5 million.

A deal was reached on Nov. 15, the same day opening statements were to begin.

On Dec. 26, 2016, Tinauris “Ty” Wise was asleep in the passenger seat of a semitrailer truck driven by defendant Erman T. Williams headed north on the Tri-State Tollway near southwest suburban Worth.

Williams, who knew Wise for several years, had previously asked him to assist him in that day’s work, according to one of Wise’s attorneys Patrick A. Salvi II, of Salvi, Schostok & Pritchard P.C.

While Wise was asleep, Williams’ truck was involved in a collision with a tow truck. Wise sustained fractures to his left hip, left arm, left elbow, nose, cervical spine, lumbar spine and ribs.

Daniel O’Meara, an ALW Towing Inc. driver, was driving in the adjacent lane at the time the two collided. Both truck drivers alleged the other driver caused the crash by improperly changing lanes, Salvi said.

Wise filed a lawsuit in 2017 against ALW Towing, O’Meara, Williams and his company, and The Auto Club Group, which plaintiffs’ attorneys contended was an agent of the towing company.

The suit alleged both drivers were partially liable for the collision because they were commercial driver’s license drivers and should have been aware of their surroundings and any potential hazards.

The Auto Club Group denied agency, asserting it did not exhibit a certain level of control to be liable for O’Meara’s actions, Salvi said.

Salvi said they intended to argue at trial that while their client recovered well from his injuries he would still likely need joint replacement and a spinal cord stimulator at some point during his life.

Wise was also represented by Salvi’s father, Patrick A. Salvi, and Aaron D. Boeder and Eirene N. Salvi of Salvi, Schostok & Pritchard.
